Additional Information: County Wins Mosque Ruling Before State Appeals Court

A state high court has ruled in favor of the county in the case regarding public notice of the mosque construction.

The Tennessee Court of Appeals ruling was handed down Wednesday and WGNS obtained a copy of the court paperwork on Friday (5/31/13). The court's decision reverses the ruling of Chancellor Robert Corlew from over a year ago.

The actual court case was labeled  "KEVIN FISHER ET AL. v. RUTHERFORD COUNTY REGIONAL PLANNING COMMISSION ET AL." "Appeal from the Chancery Court for Rutherford County"

VERBATIM:  Corlew ruled the county didn't provide adequate public notice of the Rutherford County Regional Planning Commission's meeting, where they approved construction plans for the Islamic Center of Murfreesboro. The Appeals Court filed the following statement, "We conclude that the county’s publication of the notice in the MURFREESBORO POST was sufficient under the OMA." The court documents also pointed out that information was delivered to "local radio stations" eight days prior to the meeting date. We can confirm that we do receive these notices. Despite this fact, WGNS is not in the practice of announcing public meeting notices. We do however report the information that is released during those types of meetings, but radio is not a format that would allow for simply giving an audience a list of upcoming meeting dates.

The 12-thousand square foot mosque, which opened a year ago August, is located just off Bradyville Pike on Veals Road. Plans are currently on the drawing board to continue the construction phase until they reach over 50,000 square feet. Several more additions are in the process now and under the review of those with the mosque. A recreational area is one of the items that will likely be built in the near future.
