DUI Number 4... Need We Say More?

For the 4th time a Murfreesboro man is facing a DUI charge. David Lee Hawkins was involved in a minor traffic crash on NW Broad Street near Thompson Lane Wednesday night. Officers say when they made contact with Hawkins they could smell an intoxicant on his person. While police were talking to Hawkins he reportedly stated… well, we can’t repeat what he stated on the radio but we can tell you the sentence ended with, “I’m drunk.”

A routine driver’s license check revealed the 49 year old man was driving on a revoked license. In fact, this was his second time to be charged with driving on a revoked license. To make matters worse, the car Mr. Hawkins was said to be driving was not his, it belonged to the passenger. The passenger, 28-year old Ada Moore, was charged with DUI by allowance. Moore lives in Franklin, but will have to make the trek back to Murfreesboro in June to appear in general session’s court.

Here in Tennessee DUI number four is looked upon as a more serious offense than DUI number two or three, as should be the case. The question is, how much more serious of an offense? The fourth DUI and any DUI after the fourth is considered a class E felony. A class E felony requires the convicted offender to serve a minimum of 150-consecutive days in jail. There is also a mandatory fine of $3,000 to $15,000. The culprits’ vehicle can also be seized and the offenders’ driver’s license can be revoked for 5-years. Of course in this case the vehicle being driven by the offender did not belong to him, so it cannot be seized, plus he was already driving on a revoked license.
