Robbery suspect from 2010 to remain behind bars despite appeal

A man who pleaded guilty to two counts of robbery in Rutherford County in 2010 has filed an appeal with the TN Court of Criminal Appeals in an attempt to end his six year supervised probation sentence early after he violated his probation. Charles E. May, Jr., who also plead guilty to aggravated burglary and aggravated assault in 2010, suggested he received ineffective counsel at a motion hearing that landed him behind bars.

In both 2011 and 2012, May was charged with violating his probation. In one case, he evidently tested positive for marijuana use. He then violated his probation after being cited for drug possession and for traveling to Georgia twice without his probation officer’s approval. The courts then ordered May to serve the remainder of his sentence in jail. May then filed a motion to suspend the sentence and go back on probation. The courts denied the motion, stating that they found not change in his circumstances warranting him being freed from jail.

At this point, 29-Year old May will be free from jail in 2016.
