The Affordable Care Act provides a new tax credit to help residents afford health coverage purchased through the new exchange. States like Tennessee refused to set up their own state run insurance exchanges, so Tennessee by default, went with the federal run exchange. The rules of the Affordable Care Act allow for low income residents to qualify for health insurance subsidies or credits when they buy insurance through a state established exchange. But, the problem is that low income residents in Tennessee will not receive that credit, because Tennessee never set up an exchange or marketplace. Instead, Tennessee went with the federal program by default.

If the lawsuit proves to be a successful win for the Volunteer state, it could immediately make health insurance unaffordable for thousands of Tennesseans, which kills the purpose of the Affordable Care Act all together.
