St. Louis, MO - Janae Edmondson, the Smyrna teenager who lost both of her legs in February, 2023 has been awarded $450,000 in a settlement with the City of St. Louis.
As you recall, the 17-year-old Smyrna student was in St. Louis for a volleyball tournament. While walking around the city with her parents, a vehicle went airborne and pinned the 17-year-old Smyrna student against a parked vehicle.
“Cap laws” kept the settlement low, despite the fact that her medical expenses and costs related to prosthetic legs have reportedly greatly exceeded that figure.
Caps on legal fees and damages in court cases can limit the amount of money plaintiffs can receive or defendants must pay, especially in personal injury and medical malpractice cases. However, critics believe that caps undermine the compensatory role of tort law and can be unfair to plaintiffs, particularly in catastrophic injury cases.
